Flight cancellation: Sunwing must pay $2,800 to compensate a traveler, judge rules

A Nova Scotia small claims judge orders Sunwing Airlines to compensate a traveler $2,850 after two flights to Florida were canceled.

Jason Alain Hennigar decided to sue Sunwing Airlines and Sunwing Vacations in February 2023 for the cancellation fees he had to pay.
The applicant's initial flight to Melbourne, Florida, was cancelled four months before the applicant's departure date due to unforeseen operational constraints. Having cancelled the flight, Sunwing offered Mr. Hennigar an alternative flight to Orlando on the same date.
However, additional fees were charged to the traveler, since "system prices" had changed.
Having already booked the tourist attractions he wanted to visit, Mr. Hennigar decided to pay the additional fees to go to Orlando.
However, a month before the big departure, the airline cancelled its second flight to Florida, according to the judgment handed down last month in Halifax.
The traveler therefore had to turn to the airline Air Canada, which cost him double the price initially paid.
Judge Richardson therefore ordered Sunwing Airlines to pay Jason Alain Hennigar $2,850, knowing that the company had already reimbursed the plaintiff $2,500.
At the time of publication, Sunwing has not commented on the judgment.
