Should We Be Afraid? The State Duma has adopted new amendments to the law on the seizure of vehicles

The State Duma has adopted amendments to the law, which expand the list of vehicles owned by citizens and organizations that can be used by security forces as part of the anti-terrorist operation. "NI" studied the document and found out whether car owners should be afraid?

According to the current law, before the adoption of amendments to the norms of the law, in the territories in which the counter-terrorist operation regime was introduced, security services were allowed to use cars, buses, motorcycles and trucks that were owned by citizens for the duration of the regime.
This measure was intended “to deliver persons in need of urgent medical care to medical institutions, as well as to pursue persons suspected of committing a terrorist act if delay could create a real threat to the life or health of people.”
The new amendment establishes a rule according to which vehicles belonging to citizens and organizations can be used “to ensure counter-terrorism measures.”

In addition to “vehicles” such as cars, motorcycles, all-terrain vehicles, snowmobiles and quad bikes, security forces were given the right to use “self-propelled vehicles.”
This concept includes not only means for transporting people and goods, but also special equipment that is registered not with the State Traffic Safety Inspectorate, but with the State Technical Supervision Authority.
Including agricultural machinery that can be used to perform heavy work. These can be tractors, bulldozers and excavators, regardless of the form of ownership.
The new law gives priority to the use of vehicles owned by organizations, and only in urgent cases - vehicles owned by individuals.

The exception is vehicles and self-propelled machines of “diplomatic missions, consular and other institutions of foreign states and international organizations.”
As for the reimbursement of expenses related to the confiscation of private transport to combat terrorists, they are described in the Decree of the Government of the Russian Federation, adopted back in 2008.
It states that the owner of the vehicle must submit a corresponding application to the "federal executive authority", attaching documents confirming the expenses incurred. The period for reviewing such an application is one month, after which the agency issues an order on reimbursement of expenses.
Today, the counter-terrorist operation regime is in effect in the regions of the country bordering Ukraine: in the Belgorod, Bryansk and Kursk regions.
