Having a family in Russia does not give a migrant who has previously violated the law the right to unimpeded entry into the country. This is evidenced by the materials of the Fourth Cassation Court, studied by RIA Novosti.
The legal precedent was the case of a Vietnamese citizen who arrived in Russia in September 2023 on a three-month visa, but after it expired, did not leave the country, illegally staying in the Russian Federation for another 193 days. When she subsequently attempted to enter Russia, she was denied entry for violating immigration laws.
The foreign citizen challenged this decision in court, citing the presence of family in Russia: a husband with a residence permit and a minor son born in the territory of the Russian Federation. She herself also planned to apply for a residence permit. The courts of the first and second instances sided with her, but the police succeeded in overturning these decisions in the cassation instance.
In its decision, the court indicated that, according to the Constitution of the Russian Federation, the right to unimpeded entry into the country is recognized exclusively for Russian citizens, and the right to move freely and choose a place of residence is recognized only for those who are legally on the territory of Russia.
