After defense talks about Moraes' 'diabolical' error, Gonet asks for freedom for January 8 defendant

The Attorney General of the Republic Paulo Gonet defended, this Monday 13th, the provisional release of the defendant Divanio Natal Gonçalves , arrested for the coup acts of January 8th. The statement of the PGR comes after the defense stated that the preventive detention was marked by "a succession of grotesque errors" and that "it is diabolical" the treatment given to the defendants of January 8th.
The decision will be analyzed by the Supreme Court minister and case rapporteur, Alexandre de Moraes.
According to Divanio's defense, the series of alleged errors began after a dispute in the Uberlândia District Court. Divanio was sent to serve the precautionary measures in the Criminal Enforcement Court, but he later served them in the Domestic and Family Violence against Women and Criminal Precatórios Court.
The defense further alleges that the officer responsible for the Precatórios Court "has consistently refused to provide any statement of weekly attendance," which made it difficult for the defense to prove his compliance. The lawyers also reject the escape charges, claiming that the proof that he was not a fugitive is that the Military Police, when executing the arrest warrant, found him "at his residence, wearing an electronic ankle bracelet."
Gonet agreed with the defense and stated that the certificate from the Criminal Precatory Court of the District of Uberlândia demonstrates that compliance with the precautionary measures established by the STF was being monitored in that court, and not in the Criminal Enforcement Court of Uberlândia.
"The document also confirms the defense's allegations that the defendant had been regularly complying with the precautionary measures prior to his arrest," the ruling stated. Therefore, the Attorney General's Office requests that Moraes grant the defendant provisional release , subject to the reinstatement of alternative precautionary measures, such as the electronic ankle bracelet; and summon the Federal Public Defender's Office to present its final arguments .
