A court ruling regarding comedian Léo Lins was released by CNN Brasil on Wednesday (23), days after he mocked Preta Gil 's death in yet another stand-up performance. According to the outlet, the Rio Grande do Sul Court of Justice (TJRS) guaranteed the comedian - vehemently condemned by Alexandre Frota - the right to freedom of artistic expression, by finding him innocent in a lawsuit filed by the city of Novo Hamburgo, in Rio Grande do Sul.

The action, which sought to prevent a Léo Lins show from taking place and also to collect compensation of R$500,000 for collective moral damages, was considered unfounded by the court.

A few days before the new controversy , on July 11, the TJRS dismissed a Public Civil Action filed by the Municipality of Novo Hamburgo (RS) against Léo Lins and the production company BTZ Produções Ltda. The lawsuit attempted to prevent the performance of the show "Peste Branca", scheduled for August 31, 2023 at the Teatro Municipal Paschoal Carlos Magno, and also demanded compensation for alleged collective moral damages.

In the lawsuit, the city argued that the promotional video and the show's content ridiculed the city's residents and contained racist, ableist, and fatphobic jokes. The municipality alleged that the material promoted offensive discourse and violated human dignity.

The Supreme Federal Court had already prohibited prior censorship of comedians.
