Man who killed CET agent to steal ring sentenced to more than 26 years in prison

The 25th Criminal Court of São Paulo sentenced the man accused of killing CET (Traffic Engineering Company) agent José Domingos da Silva to more than 26 years in prison, in a closed regime, during the theft of his wedding ring on March 13 of this year. The crime took place in the Vila Sônia region, west of São Paulo.

The trial, via videoconference, took place last Monday (14) in a room at the São Paulo Criminal Courthouse in Barra Funda. The defendant — Luan Schiavoto Gomes Gabriel, 25 — was handcuffed. The report did not locate his defense. At the hearing, he denied participation in the crimes.

In total, Luan was sentenced to 26 years and 8 months in prison for robbery followed by murder. In the ruling, the judge stated that the defendant is not entitled to amnesty, pardon, or pardon. The decision can be appealed.

The traffic agent was working on Osiris Magalhães de Almeida Street, near Professor Francisco Morato Avenue, when he was shot, around 8:45 am.

Minutes earlier, around 8:20 a.m., another person had been robbed of a wedding ring in Campo Limpo, a neighboring neighborhood in the South Zone. Luan was convicted of both crimes.

Another man is also accused of involvement. According to the sentencing document, which this reporter had access to, he did not appear at last Monday's hearing, despite having a defense attorney. Judge Carlos Alberto Corrêa de Almeida Oliveira ordered the cases separated and gave him 15 days to respond.

The report was unable to contact Luan's defense to find out whether he will appeal the decision.

The defendant remained silent at Monday's hearing, answering only questions posed by his lawyer. He denied participating in the robberies or killing the CET agent.

Silva's body camera revealed he was issuing a ticket to a truck when he was approached by a man on a motorcycle, who announced the robbery. Shortly afterward, the shot rang out.

The sentence reveals similarities between the two cases. In the first, the victim reported walking home and seeing a motorcycle pass by near his condominium, followed by another parked further ahead. The driver of the motorcycle was wearing an open-face helmet and staring at him.

"When he got closer, he looked again and saw the defendant Luan pulling out his gun and announcing the robbery, saying 'go on, you're a police officer and I'm going to shoot you twice in the face', demanding the ring," the text says.

The robbery victim claims that Luan, whom he recognized at the police station, pointed the gun at his face and cocked it. He had to turn his back, and the robber drove away. At that moment, he saw another motorcycle appear and chase the thief.

"It appears that the threats to 'shoot someone in the face' were repeated in both crimes investigated, [statements by the victim - first] and in the images from cameras related to the crimes, in particular, the images from the personal cameras of the fatal victim", says the content of the sentence.

According to the Court, in the audio from the CET agent's body camera, it can be seen that the defendant says the same phrase he said to the previous victim: "Go on, you're a police officer, I'm going to shoot you twice in the face."

At the hearing, Luan denied involvement in the crimes. He said he was arrested at his grandfather's farm, where he was working. He also said he didn't own a motorcycle or a gun, and claimed he had never robbed anyone.

His lawyer said, according to the lawsuit, that the Public Prosecutor's Office 's complaint is weak, saying it is based "on conjecture and artificial constructions of evidence, without a solid factual basis."

Among other things, the defender stated that the visual recognition was carried out under media influence and without legal guarantees.

The lawyer said that no weapons were seized, and that the motorcycle used in the crime was not found.
