Court partially rules in favor of CTT and reduces Anacom's fine to 275 thousand euros

The Court of Appeal partially ruled in favor of CTT, which appealed a ruling by the Competition, Regulation and Supervision Court, and reduced the fine imposed on the company for violating universal postal service obligations to 275 thousand euros.
According to a ruling, to which Lusa had access, the Court of Appeal decided to “partially uphold the appeal filed by the company CTT – Correios de Portugal” and sentence it to a single fine of 275 thousand euros, compared to the 400 thousand euros determined by the Competition Court.
The Court of Appeal considered “the overall picture of the facts in question, the degree of guilt and unlawfulness resulting from them, the existence of special prevention needs (the company has already been convicted for committing other offences of mere social order), the lack of obtaining economic benefits (it was not proven that it had obtained or intended to obtain advantages resulting from the practice of these offences)”, as well as “its economic situation”, and concluded that it appears “appropriate and proportionate to the facts” to judge “partially, admissible the present appeal, and, consequently, to sentence the company” to a single fine of 275 thousand euros.
The ruling recalled that the Competition Court sentenced CTT, in a decision dated October 30 last year, to a fine of 400 thousand euros for violations of universal postal service obligations, including in the measurement of service quality levels.
Before that, in May 2024, the National Communications Authority (Anacom) had reported the application of a fine of close to 400 thousand euros, with CTT indicating that it would appeal the decision.
