Judge María Servini on Cristina Kirchner: "I don't see her spending much time in prison."


Federal Judge María Servini addressed the legal situation ofCristina Kirchner , who was convicted of corruption and is currently under house arrest . Speaking to El Destape Radio, she warned that she does not believe the former president will serve her full sentence and suggested the conflict could be resolved through political means .
"When house arrest becomes problematic, there comes a time when it can't be sustained. I wouldn't say soon, but I don't see him spending much time in prison," said the judge with years of experience in the judiciary.
Servini pointed out that, since the return of democracy, no Argentine president has served a full sentence. "Which president has served his entire prison sentence?" he asked ironically. He only mentioned Carlos Menem , who was imprisoned for a brief period, as an exception.
According to the judge, Cristina Kirchner 's case could lead to a political solution to avoid constant confrontation. "I think it's possible that a political way can be found to resolve the situation," she said.
He also stated that he cannot speak in depth about cases like the former president's because he has never been involved in similar cases, but stressed that experience indicates that "it would be a permanent conflict."
Asked about the role of the highest court, María Servini opined that the current Supreme Court is "underpowered" due to a lack of members. "With only three members, if the composition of the Court changes, something could change," she emphasized.
In this regard, he announced that a bill to expand the Court to seven members could be proposed in 2026. This modification, he explained, could have a direct impact on the resolution of complex legal cases, including the situation of the former vice president.
María Servini insisted that politics could be the way to resolve the current situation. “Politics always finds a solution,” she stated. With this statement, she made it clear that Cristina Kirchner 's judicial future could be resolved outside the courts.
